ActivTime is a free timer for iPhone, with an optional one-time Pro unlock. These terms are the agreement between you and its developer covering how you may use it, and what we do and don’t promise.

1. The agreement

By downloading or using ActivTime (the “app”) you accept these terms. If you don’t accept them, don’t use the app.

The agreement is between you and the developer of ActivTime (“we”, “us”) — an independent developer based in Sri Lanka, named on the app’s App Store listing and reachable at the address in section 14.

Because the app is distributed through the App Store, Apple’s Licensed Application End User License Agreement also applies. These terms supplement it; where the two genuinely conflict, Apple’s terms govern to the extent Apple requires.

2. Health and safety — read this one

ActivTime is a timer, and nothing more. It is not a medical device. It does not give medical, fitness, or nutritional advice, monitor your physical condition, check your form, or have any way of knowing whether a given exercise is safe for you.

  • Consult a qualified physician before beginning any exercise programme, particularly if you are pregnant, recovering from injury or surgery, living with a medical condition, or new to exercise.
  • Stop immediately if you feel pain, dizziness, faintness, shortness of breath, or any discomfort. A timer counting down is not a reason to keep going.
  • You are solely responsible for how you exercise, for the exercises you choose, and for your own safety while doing them.

You use the app, and exercise while using it, entirely at your own risk, and you assume all risk of injury arising from doing so.

3. Your licence

Downloading the app gives you a personal, non-exclusive, non-transferable licence to use it on Apple devices that you own or control, in accordance with the App Store Usage Rules. Buying ActivTime Pro extends that same licence to the unlocked features — it is a licence to use the software, never a sale of the software itself.

You may not:

  • Redistribute, sell, rent, lease, sublicense, or otherwise make the app available to anyone else.
  • Reverse engineer, decompile, or disassemble the app, except to the precise extent that applicable law expressly permits despite this restriction.
  • Remove or obscure any copyright or proprietary notice.
  • Use the app, or anything extracted from it, to build a competing product.

4. What’s free, and what ActivTime Pro costs

The app is free to download. The timer, the sound and haptic cues, and your complete session history are free, with no row limit and no date cutoff on what you can see. Loading a preset you have already saved is free too.

ActivTime Pro is a single one-time in-app purchase that unlocks the progress charts and stats, adding your own exercises, and saving presets. It is not a subscription: you are charged once, and nothing renews. The price you pay is the one the App Store shows in your own currency at the moment you buy.

The unlock is tied to the Apple Account that bought it. Restore Purchase in Settings recovers it on a new device or after reinstalling, at no further cost. Family Sharing is not enabled for this purchase.

Apple processes every payment. We cannot charge you, and we never see your payment details. Refunds are likewise handled by Apple under the App Store Terms of Sale, so we cannot issue one — request one through Apple’s Report a Problem page or Apple Support. If Apple grants a refund, ActivTime Pro is revoked and the features it unlocked return to their locked state. Anything you already created with Pro stays yours: custom exercises and presets you saved remain listed, usable and deletable — you just can’t add new ones.

We may change what Pro costs, or what it includes, for future purchasers. If you have already bought it, you keep what you paid for — we will not move an existing Pro feature behind a further charge, and we will not start charging for the timer, the cues, or your history.

5. Availability and updates

We may update the app to add features, fix defects, or keep it working with new versions of iOS. Updates arrive through the App Store and may require a reasonably recent version of iOS.

We may also stop distributing or supporting the app at any time. A copy you have already downloaded will keep working for as long as your device supports it, but we don’t promise indefinite availability, compatibility with future hardware, or continued updates. If we stop distributing the app, an unlock you have already bought stays unlocked for as long as Apple keeps returning that transaction to your device.

6. Your data

Everything the app records stays on your device. We collect nothing — the Privacy Policy sets out exactly what is stored and where.

Because we hold no copy, your session history is yours to look after. We cannot restore it if you delete the app, lose your device, or reset it, and we are not responsible for data lost that way.

7. Intellectual property

The app, its name, logo, design, and source code are owned by us and protected by copyright and other laws. These terms grant you no right to use our name, logo, or trademarks.

8. Disclaimer of warranties

The app is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

In particular, we don’t warrant that the app will be uninterrupted or error-free, that its timing will be perfectly accurate under all conditions — background execution, device performance, and operating-system behaviour all affect it — or that it will meet your requirements. Buying and restoring ActivTime Pro both depend on the App Store being reachable, which is not something we control.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, nor for personal injury, loss of data, or lost profits, arising out of your use of or inability to use the app.

Our total liability for any claim relating to the app will not exceed the amount you actually paid us for it, including anything you paid for ActivTime Pro.

Nothing in these terms limits any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

10. Apple

Apple is not a party to these terms and has no obligation to provide maintenance or support for the app. Apple is not responsible for addressing any claim relating to the app, including product liability, legal compliance, or consumer protection claims — those are between you and us.

Apple and its subsidiaries are third-party beneficiaries of these terms and, on your acceptance, have the right to enforce them against you.

11. Changes to these terms

We may revise these terms. The updated version will be posted on this page with a new date at the top, and continuing to use the app after that counts as accepting it. Where a change materially affects your rights, we’ll give reasonable notice in the app.

12. General

If any provision of these terms is found unenforceable, the rest remain in force. Our not enforcing a provision on one occasion is not a waiver of it. Together with the Privacy Policy and Apple’s standard licence terms, this is the entire agreement between us about the app.

13. Governing law

These terms are governed by the laws of Sri Lanka, without regard to its conflict-of-law rules, and the courts of Sri Lanka have non-exclusive jurisdiction over any dispute.

If you are a consumer somewhere whose law gives you mandatory protections, nothing here deprives you of them, and you keep the right to bring proceedings where that law allows.

14. Contact

A support address will be published here before ActivTime is released on the App Store. Until then there is no monitored channel for these terms.
